General terms and conditions for online orders

I. Scope of application

For online orders in our web store at www.selmiswiss.com (the “website” and in the said “web store”), thus for the business relationship between the orderer (customer) and SelmiSwiss GmbH – Ramsener Str.5 -78262 Gailingen am Hochrhein – Germany – DE449852060 / HRB 73192 (hereinafter referred to as “SelmiSwiss”), the following General Terms and Conditions (GTC) in force at the time of the order apply exclusively. Deviating, contradictory or additional general terms and conditions do not form part of the contract even if they are known unless expressly agreed in writing. These general terms and conditions shall also apply as a framework agreement for all subsequent legal transactions between the parties.

Customers are both consumers within the meaning of the German Consumer Protection Act and entrepreneurs. Entrepreneurs are natural or legal persons or companies with legal capacity for whom this contract forms part of the operation of their business. Enterprises are all organizations with a permanent independent economic activity, even if they do not aim to make a profit.

II. Contract

Our offers are subject to change and non-binding. We reserve the right to make technical and other changes within reasonable limits.

Your order on www.selmiswiss.com constitutes an offer to enter into a purchase contract with SelmiSwiss. The order is placed by clicking on the “Buy” button and ticking the box “I accept the general terms and conditions (GTC)”. SelmiSwiss saves the text of the contract and sends you an order confirmation by e-mail. You can log in to view and modify your orders and personal data at any time.

Acceptance of the offer by SelmiSwiss constitutes acceptance of the purchase contract and the right to delivery of the goods. The confirmation of receipt of the order sent automatically by SelmiSwiss does not constitute acceptance of the order. Rather, the acceptance of the offer takes place by sending you the shipping confirmation to the e-mail address provided. Invoicing is in Euros (EUR).

The sale is made only in quantities for domestic use and exclusively to adults, i.e. persons who have reached 18 years of age. You certify that the information about your age is true.

You may not share with third parties the password necessary to place orders. If you do so, you will also be responsible for those third parties’ orders. You are responsible for any orders placed with your password and any resulting claims.

III. Price

For consumer transactions: unless otherwise specified, the prices quoted are inclusive of VAT. The total amount shown in the shopping cart includes the gross price of the product and the gross shipping costs. For entrepreneurs, the Prices we quote do not include VAT, unless otherwise specified.

IV. Terms of payment and non-payment

EU customers have the possibility to pay by credit card, PayPal or bank transfer. The invoice is sent together with the package. Payments by the customer shall only be deemed to have been made upon receipt on our business account. Until full payment has been made, the ordered goods remain the property of SelmiSwiss GmbH.

Due to limitations of the Stripe and Paypal platforms: CBD products must be paid by wire transfer.

V. Consumers’ right of withdrawal

Cancellation and Refunds

The customer can cancel his order before shipment or return the goods without giving a reason within 15 working days of receipt. You will find all the important information on how to proceed with a return on our Returns page.

VI. Shipping and transportation

During the processing of your order, we will offer you the available shipping options. Deliveries are made Monday through Friday and, in some regions, also on Saturdays and Sundays.

• The delivery time is counted from the moment the product is shipped.
• Shipping is done from three platforms: one located in Spain (domestic shipping), one located in Switzerland (domestic shipping) and one located in Germany (domestic and international shipping).
• Our rates are valid only for shipments within the specified territory. For more information on rates and shipping options, please see our Rates and Shipping Options table.

Gross shipping costs are included in the total amount indicated in the shopping cart.

Shipping Rates and Options (Spain – nationwide shipping)

Fixed shipping cost: 6,00 €.

Shipping Rates and Options (Switzerland – nationwide shipping)

Fixed shipping cost: 5,00 €.

Shipping Rates and Options (from Germany)

Fixed shipping cost to Germany: 5,00 €.

Standard delivery time is 2-4 business days (Monday through Friday, except holidays).

VII. Minor service changes

Changes or deviations from the agreed service are reasonable for the customer if they are minimal and objectively justified. This applies especially to deviations caused by the item (e.g. in dimension, color, structure, etc.).

VIII. Indemnification, Product Liability, Warranty, Warranty

Compensation for damages due to the breach of an obligation arising from the contractual relationship shall be paid as required by law. Claims for damages must be brought before the courts within 3 years from the time of knowledge of the damage, otherwise the statute of limitations expires. The same applies to claims based on German product liability law. All instructions on the packaging and package inserts must be observed. No liability is assumed for deviating application and/or handling.

You are entitled to a statutory warranty in accordance with German law. The period is 24 months for consumers and 12 months for entrepreneurs from receipt of the goods and, in the case of services, with the completion of the service. If there is no room for a replacement or improvement (not possible, too much effort, unreasonable, time delay, etc.), then you are entitled to a price reduction or, if the defect is not minor, to cancel the contract (redhibition). Warranty claims do not apply to minor changes to the service in accordance with point VII.

For entrepreneurs only: You must inspect the delivered goods within a reasonable time for defects and report them in writing within one week of receipt; otherwise, the warranty claim is excluded. You must notify us in writing of hidden defects within one week of discovery. Timely dispatch is sufficient to meet the deadline. The entrepreneur shall bear the entire burden of proof for all conditions of complaint, in particular the defect itself, the time of discovery of the defect and the timeliness of the complaint.

X. Choice of law, jurisdiction

German law applies. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The language of the contract is German.

XI. Data protection, change of address and copyrights

The customer consents to the personal data contained in the sales contract also being stored and processed automatically by us for the purpose of fulfilling this contract. The customer is obliged to provide us with changes to his domicile or business address as long as both parties have not fully complied with the contractual legal transaction. If notification is omitted, remarks shall be deemed to have been received if they have been sent to the last published address. All logos, samples, catalogs, brochures, flyers, illustrations and the like are our intellectual property; the customer does not receive any rights of use or exploitation in the absence of a separate agreement.
